The short version (not a substitute for the actual terms below)

nvira is meant to be an open place to post and talk about pretty much anything. We're not going to police your opinions or your taste. But a handful of things are flatly illegal to host — child sexual abuse material, credible threats of violence, doxxing, non-consensual intimate images, and illegal goods/services — and those get removed and reported, no exceptions.

You keep ownership of what you post; you're just giving us permission to display it. Adult content is allowed but walled off behind an 18+ confirmation. We can remove content or suspend accounts that break these rules, and we're not liable for what other users post. Full details below.

1.Acceptance of these Terms

These Terms of Service ("Terms") are a legal agreement between you and nvira, operated by ponko ("we", "us", "the Operator"), governing your access to and use of nvira.sbs, its chat features, and related services (together, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.

2.Age & Eligibility

You must be at least 13 years old to create an account or use the Service. If you are under 18, you may only use the general (non-adult) areas of the Service, and you represent that you have your parent's or legal guardian's permission to use it if that's required where you live.

Access to adult/NSFW areas of the Service (see Section 6) is restricted to users who are at least 18 years old and who affirmatively confirm their age. We do not knowingly collect personal information from children under 13; if we learn that an account belongs to someone under 13, we will terminate it.

3.Your Account

You're responsible for the security of your account, including your password, and for everything that happens under your account. Use a real, working email address so we can reach you about your account (e.g. verification, security, or moderation notices). Don't share your login with anyone else, and tell us right away if you think your account's been compromised.

You may not create an account for the purpose of evading a ban or suspension, impersonate another real person without clearly labeling a parody/fan account as such, or use automated means (bots, scrapers) to create accounts in bulk.

4.Your Content

"Your Content" means anything you post, upload, or send through the Service — posts, comments, images, messages, and anything else. You own your content. We don't take ownership of it just because you posted it here.

To operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute Your Content solely as necessary to run, maintain, and improve the Service (for example: showing your post to other users, generating thumbnails/previews, or keeping backups). This license ends when you delete the content or your account, except where content has been shared with, or reported by, other users, or where we're required to retain it (e.g. for a legal hold or an active moderation case).

You're solely responsible for Your Content and for having the rights to post it. You represent that Your Content doesn't infringe anyone else's rights and doesn't violate these Terms or applicable law.

Private messages: direct messages and group chats on nvira are end-to-end encrypted by default — see our encryption explainer for how that works and its current limits (for example, attachments in chat aren't encrypted yet). Because encrypted message content isn't something we can technically access, the content-moderation tools described in this document apply to it only to the extent a participant reports it to us directly.

5.Our Content Philosophy & What's Not Allowed

nvira exists to be an open place to post and talk about pretty much anything — we're not in the business of policing opinions, taste, or how you say things. That said, the following is prohibited on the Service, without exception, because it's illegal, creates serious legal exposure for us and other users, or causes real harm:

  • Child sexual abuse material (CSAM) in any form, including fictional/drawn depictions of minors in a sexual context. Zero tolerance — we report this to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by law.
  • Non-consensual intimate imagery ("revenge porn") or sexual content involving a real, identifiable person posted without their consent.
  • Credible threats of violence against a specific person or group, or content that incites imminent unlawful violence.
  • Terrorism or violent extremism: content that promotes, recruits for, or provides material support to a terrorist or violent extremist organization or act.
  • Doxxing: posting someone else's private information (home address, phone number, financial/government ID info, non-public workplace, etc.) without their consent and with intent to harass, intimidate, or enable harm.
  • Illegal goods or services: facilitating the sale of illegal drugs, weapons trafficking, stolen goods/data, counterfeit currency, or similar.
  • Fraud and scams: phishing, pyramid/Ponzi schemes, fake giveaways, or other content intended to deceive people out of money or personal information.
  • Malicious software or hacking tools distributed with intent to damage, disrupt, or gain unauthorized access to systems.
  • Infringing content: posting someone else's copyrighted or trademarked work without a legal right to do so (see Section 7).
  • Targeted harassment or stalking of a specific individual — sustained, unwanted contact or campaigns intended to intimidate or silence someone (this is distinct from criticism, satire, or heated disagreement, which are allowed).
  • Spam: unsolicited bulk messaging, automated posting, or manipulating votes/engagement through fake accounts or bots.

Outside of the above, we intentionally keep our content rules minimal. Anything else — including content that's rude, offensive, explicit (see Section 6), controversial, or that other users simply dislike — is allowed unless it falls into one of the categories above or otherwise violates the law.

6.Adult (18+) Content

Sexually explicit or graphic content is allowed only within areas of the Service that are gated behind an 18+ age confirmation, and only where it's clearly fictional, or depicts real, identifiable, consenting adults. It must never depict, imply, or be styled to resemble a minor. It must be tagged/flagged appropriately so it doesn't appear outside age-gated areas. Non-consensual, exploitative, or otherwise illegal sexual content is prohibited everywhere on the Service, adult-gated or not (see Section 5).

7.Copyright & DMCA Policy

We respect intellectual property rights and expect you to as well. If you believe content on the Service infringes your copyright, you can send a takedown notice to our designated agent at [email protected] under the Digital Millennium Copyright Act (17 U.S.C. §512). To be effective, your notice must include:

  1. A physical or electronic signature of the copyright owner or someone authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to be infringed;
  3. Identification of the material you claim is infringing, with enough detail for us to locate it (e.g. a URL);
  4. Your contact information — address, phone number, and email;
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you're authorized to act on the copyright owner's behalf.

Upon receiving a valid notice, we'll remove or disable access to the material and notify the user who posted it. That user may submit a counter-notice if they believe the removal was a mistake or misidentification, containing their signature, identification of the removed material and its prior location, a statement under penalty of perjury that they have a good-faith belief the material was removed in error, their contact information, and consent to the jurisdiction of a federal court. If a valid counter-notice is received, we may restore the content within 10–14 business days unless the original complainant files a court action first.

We terminate the accounts of users determined to be repeat infringers in appropriate circumstances.

8.Moderation & Enforcement

We reserve the right, but not the obligation, to review, remove, or restrict access to any content, and to warn, suspend, or permanently ban any account, at our discretion — including for violating these Terms, at the request of law enforcement or legal process, or to protect the Service and its users. We try to be proportionate: minor or first-time issues are typically handled with a warning or temporary suspension before a permanent ban, but we reserve the right to act immediately and without warning for severe violations (like anything in Section 5).

Moderation decisions are made at our discretion and, while we aim to be fair, these Terms don't entitle you to a particular outcome, explanation, or appeal process for any specific moderation action.

9.Third-Party Links

The Service may contain links to third-party websites or content posted by users that we don't control. We're not responsible for the content, accuracy, or practices of any third-party site, and linking to something doesn't mean we endorse it.

10.Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, for any or no reason, including for violating these Terms. Sections of these Terms that by their nature should survive termination (e.g. Sections 4, 7, 11–13, and 15) will continue to apply after your account is closed.

11.Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DON'T VET, ENDORSE, OR GUARANTEE THE ACCURACY OF CONTENT POSTED BY USERS.

12.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY CONTENT POSTED BY OTHER USERS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY ISN'T EXCLUDED, THE OPERATOR'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER. SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13.Indemnification

You agree to defend, indemnify, and hold the Operator harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms.

14.Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date at the top of this page and, where practical, post a notice on the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.

15.Governing Law & Disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in a court of competent jurisdiction within the United States, and you consent to that jurisdiction and venue.

Note: this clause is intentionally general (jurisdiction not pinned to a specific state) per the Operator's preference. A court may require a more specific venue/jurisdiction to actually enforce a dispute — this is one of the items worth a quick lawyer review if this document is relied on for a real legal dispute.

16.General Provisions

If any provision of these Terms is found unenforceable, the rest remain in full effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms or your account without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with any policies referenced in them, are the entire agreement between you and us regarding the Service.
